1. OBJECT

1.1. Luneur Park S.p.A. (hereinafter, "Luneur") provides a Season Ticket service entitled "Silver" (hereinafter, the "Season Ticket"), which provides access to the "Luneur Park dell'Eur" amusement park, located in Rome, between Via delle Tre Fontane, Viale dell'Artigianato, Viale dell'Industria and Viale della Pittura, (hereinafter referred to as the "Park"). The service operates during the relevant opening days and hours of the Park and provides for unlimited use of the rides and games (with the exception of prize-winning games and access to and use of the Splash Zone water games) located therein, hereinafter known as the "Attractions". The service is provided to a child, or two children who are siblings (where a "child" is intended as being under 13 years of age when the Season Ticket is activated), hereinafter referred to individually and jointly as the "Season Ticket Holder(s)") and 1 (one) or 2 (two) accompanying adult(s) (an adult being a person aged 18 years or over) who may be different on each occasion (hereafter, the adult and the two accompanying adults are referred to individually and jointly as "Accompanying Adult(s)").

1.2. The Season Ticket service includes the following packages:

1. SILVER SEASON TICKET for 1: valid for 1 (one) Holder and 1 (one) Adult Companion, the latter may be different on each occasion;

1. SILVER SEASON TICKET for 2: valid for 2 (two) sibling Holders and 2 (two) Adult Companions; the latter may be different on each occasion.

 (The Silver for 1 and Silver for 2 Season Tickets are hereinafter also jointly referred to as the "Season Tickets").

 1.3.  Holders of a Silver for 1 and Silver for 2 Season Tickets are entitled to the following benefits:

1. a) a dedicated ticket for the Splash Zone (water games) for Holders;
2. b) 10% discount on the purchase of merchandise items;
3. c) 10% discount at the refreshment points.

1.4. These General Terms and Conditions apply to Season Tickets acquired in the year 2023. 

1. SEASON TICKET ACQUISITION AND DURATION 

2.1        You can acquire a Season Ticket in the following ways:

• by compiling the registration form on the official Luneur website (www.luneurpark.it/abbonamenti) (hereinafter, the "Form") and attaching a photo of the Holder(s) in jpg format. Once the Form has been completed, the holder will receive a pdf document at the email address indicated during registration, the latter must be presented to the Luneur Park Cash Desk (hereinafter, the "Season Ticket Desk") in order to collect the "Season Ticket Card";

2.2       The Season Ticket may be acquired by the person exercising parental control over the Holder(s) or by another person, on the understanding that, in such a case, the latter declares, by signing these General Season Ticket Terms and Conditions, that he or she has first obtained the consent of the person exercising parental control over the Holder to acquire the Season Ticket (hereinafter referred to as the "Owner"). Owners not exercising parental control over the Holder(s) shall indemnify and hold Luneur harmless from any blame, claim or action asserted on any grounds and for any reason, by third parties, for damage or other harm resulting from the untruthful representation of compliance with the above obligations.

2.3       The Season Ticket is valid for one calendar month, starting on 13 January 2023, with automatic monthly renewal until 31 December 2023, inclusive, unless terminated earlier.

1. HOW TO USE THE SEASON TICKET AND ACCESS THE PARK

3.1        The "Season Ticket Card" is strictly personal and non-transferable and must be shown directly at the Park access gates every time the Season Ticket Holders and their Adult Companions wish to enter. Season Ticket holders and Adult Companions without a "Season Ticket Card" or Season Ticket holders without an Adult Companion will not be allowed to enter the Park. After having shown the "Season Ticket Card" at the Park access gate, Season Ticket Holders and their Companions will receive special bracelets which must be worn and which will allow them to use the Attractions without restriction (except for games with prizes and access to and use of the Splash Zone with water games). The aforementioned bracelet is valid only for the day on which it is assigned for use.

3.2       The Owner is responsible for the safekeeping of the "Season Ticket Card". If the "Season Ticket Card" is lost or stolen, Luneur, following receipt of a special declaration of theft or loss from the Owner, may issue a duplicate at a cost of €5 (five/00).

3.3       Luneur reserves the right, at any time and without prior notice, to change the opening hours, restrict or suspend access to the Park and/or one or more Attractions where this is deemed necessary by Luneur for organisational, commercial, meteorological reasons. The latter actions may also be taken to protect the safety of the Park's users, for the protection of public safety or to comply with measures taken by the competent authorities.

Luneur may also:

1. deny access to the Season Ticket Holders and their Adult Companions if the Park's maximum capacity has been reached;
2. suspend or cancel the Season Ticket without notice and deny access to the Park by Season ticket Holders and their Adult Companions in case of violation of Regulations applicable to the Park (as defined below) and the Attractions;
3. propose events, initiatives or attractions not comprised in the Season Ticket, if relevant express consent has been given.

1. SEASON TICKET PRICES

The prices of the season tickets are as follows:

• MONTHLY SILVER SEASON TICKET for 1 

1. One-off Season Ticket activation charge (per calendar year): €49.00;
2. Monthly rate: €20.00

At the time of acquisition of the Season Ticket, the full amount charged will be €69.00, with €20.00 to be charged per month thereafter.

• MONTHLY SILVER SEASON TICKET for 2

1. a) One-off Season Ticket activation charge (per calendar year): €69.00;
2. b) Monthly rate: €35.00

At the time of acquisition of the Season Ticket, the full amount charged will be €104.00, with €35.00 to be charged per month thereafter. 

1. PAYMENT PROCEDURES AND METHODS 

5.1. The cost for Silver Season Tickets for 1 and for 2 will be charged on the day of acquisition for the first month of validity and on every first day of the calendar month for the subsequent months of automatic renewal.

5.2. The accepted payment methods (the "Payment Methods") are exclusively credit cards (excluding Diners), debit cards (Mastercard and Visa circuit) and the Poste Pay card.

5.3. If a charge is not successful due to expiration of the Payment Method, lack of funds or any other reason, and if the Payment Method has not been updated, Luneur will notify you by email of the non-renewal by the end of the calendar month in which the monthly fee could not be charged. If the payment method is not updated, Luneur reserves the right to suspend access to the Park until a valid Payment Method is notified. By updating the Payment Method by the last day of the month in which the renewal was due, you authorise Luneur to charge the cost of the Season Ticket to the updated Payment Method. The Owner is responsible for non-payments relating to the Season Ticket.

For certain Payment Methods, the issuer may charge specific fees, e.g. for international transactions or other charges associated with the processing of each Payment Method. These commissions will be the sole responsibility of the Owner. For more information, please check with the entity handling your Payment Method.

5.4. Failure to pay by the last day of the month in which the automatic renewal is scheduled will invalidate the Season Ticket. A new Season Ticket can be obtained online by paying the relevant fee plus the monthly rate. Alternatively, it may be renewed at the Season Ticket Desk, by paying a one-off amount (by credit card, debit card or Poste Pay on the Visa, Mastercard, or American Express circuit) corresponding to the total amount of the outstanding monthly payments and the total amount of the monthly payments remaining at the end of the calendar year, thereby renewing the Subscription until 31 December 2023 (in this case, it will not be necessary to pay the Season Ticket activation charge again).

1. CANCELLATION

6.1. You can cancel your Luneur Park S.p.a. Season Ticket at any time, exclusively by accessing the Season Ticket Management area of the official Luneur Park website (https://shop.luneurpark.com/Gestione).

6.2 In the event of non-renewal, and regardless of the date of acquisition, the Season Ticket will expire on the last day of the month in which it was valid.

6.3. To the extent permitted by applicable law, payments are non-refundable. No refunds or credits will be granted for partially used Monthly Season Tickets periods.

1. PARK REGULATIONS

7.1        The Owner declares and guarantees to have read and accepted the Park Regulations published on the Luneur website https://www.luneurpark.it/regolamento-parco/ (hereinafter, the "Park Regulations").

7.2       Owners undertake to respect and ensure that Holders and Adult Companions respect the Park Regulations, the Attraction Regulations as well as any further instructions given by Luneur or its employees and/or collaborators.

7.3       In case of violation of the provisions of the Park Regulations (as defined below) or of the Attraction Regulations, or improper or incorrect use of the Season Ticket by the Owner and/or the Season Ticket Holders and/or their Adult Companions, Luneur reserves the right to terminate the Season Ticket pursuant to Article 1456 of the Italian Civil Code and, in any case, to deny the Season Ticket Holders and their Adult Companions access to the Park. 

1. RESPONSIBILITY

8.1        The Owner is liable to Luneur and third parties for any damage to property and/or persons resulting from or connected to the conduct of the Season Ticket Holders and their Adult Companions and/or failure of Season Ticket Holders and their Adult Companions to comply with the Park and Attraction Regulations. The owner shall indemnify and hold harmless Luneur from any direct or indirect damage to persons and/or property, including damage caused to the Park and its facilities, arising from the conduct of the Season Ticket Holders and their Adult Companions and/or failure of Season Ticket Holders and their Adult Companions to comply with the Park and Attraction Regulations.

8.2       The Owner shall be liable for any direct or indirect harm to the person and/or property of the Season Ticket Holders and/or their Adult Companions caused by the conduct of the Season Ticket Holders and/or their Adult Companions and/or the failure of the Season Ticket Holders and/or their Adult Companions to comply with the Park and the Attraction Regulations. The Owner shall indemnify and hold Luneur harmless from any direct or indirect damage to the person and/or property of the Season Ticket Holders and/or Their Adult Companions caused by the conduct of the Season Ticket Holders and/or Their Adult Companions and/or by the failure of the Season Ticket Holders and/or Their Adult Companions to comply with the Park or Attraction Regulations. 

1. CHANGES TO THE GENERAL SEASON TICKET TERMS AND CONDITIONS

Luneur reserves the right to unilaterally modify these Season Ticket General Terms and Conditions by publishing the updated/amended text on its website www.luneurpark.it. 

1. FAILURE TO USE THE SEASON TICKET

Failure to use the Season Ticket for reasons not attributable to Luneur will not entitle you to any refund for any reason, title or cause.

1. PRIVACY POLICY

The Season Ticket Owner declares to have read the Luneur "Privacy Policy" published on the latter's website https://www.luneurpark.it/privacy-policy/ and to have consented to the processing of personal data provided for the purpose of acquiring the Season Ticket by completing and signing the dedicated form attached to these General Season Ticket Terms and Conditions. 

1. NOTICES

Luneur will send Season Ticket information to the Owner exclusively by email to the address indicated at the time of acquisition.

For this reason, the Owner undertakes to provide Luneur with a valid and operational email address and to promptly update it on the website www.luneurpark.it in the event of changes.

1. USE OF PERSONAL IMAGE 

14.1 Without prejudice to Park Regulation provisions, by signing these Season ticket General Terms and Conditions, the Owner exercising parental control over the Holders hereby consents to the free use of the Holders' image by Luneur or its assignees if said image is captured inside or near the Park by video-recording or photography (including group photos) or any other recording means, and hereby waives any and all exceptions or claims in this regard. Images of the Season Ticket Holders may be used by Luneur and/or its assignees for any of the Park's communication, information and/or advertising purposes through the use of any form of communication or broadcasting media (including but not limited to newspapers, magazines, brochures, internet, TV, etc.).

14.2 If the Owner does not exercise parental control over the Season Ticket Holders, said Owner declares to have received express consent from the person exercising parental control over the Season Ticket Holders to use images of them subject to the terms and conditions set out in Clause 14.1 above.

14.3. Regarding cases envisaged by Clause 14.2, Owners not exercising parental control over Season Ticket Holders shall indemnify and hold Luneur harmless from any blame, claim or action asserted on any grounds and for any reason, by third parties, including the Season Ticket Holders themselves, for damage or other harm resulting from the untruthful representation of compliance with the above obligations.

1. PARTIAL NULLITY

Should one or more provisions of these Season Ticket General Terms and Conditions be deemed invalid, illegal or unenforceable, this shall not affect the validity, legality and enforceability of the remaining provisions, which shall continue to retain their full force and effect. 

1. APPLICABLE LAW AND JURISDICTION

These Season Ticket General Terms and Conditions are governed by Italian law and interpreted in accordance with them. For any dispute that may arise regarding the execution, interpretation or validity of these Season Ticket General Terms and Conditions, the Court of Rome will have exclusive jurisdiction.

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Owner declares to specifically accept the following articles of the aforementioned Season Ticket General Terms and Conditions:

The Owner expressly declares to have read, understood and to accept in full and without reservations:

- the Season Ticket General Terms and Conditions;

- the Park Regulations and subsequent amendments and additions;

which form an integral and substantial part of the contract between Luneur and the Season Ticket Owner together with the information disclosure on the processing of personal data pursuant to Article 13 of Italian Legislative Decree no. 196/2003 and the GDPR (Annex 1).

Personal data

Pursuant to Article 13 of the GDPR, we hereby inform you that your personal data will be processed by Luneur S.p.A., with registered office in Rome, Via Giovanni Battista De Rossi no. 13, Tax Code, VAT number and Rome Companies Register no. 09792151004 (hereinafter also referred to as "Luneur") in compliance with current legislation on the protection of personal data and, in any case, with the principles of confidentiality to which Luneur adheres.

1. Purpose of processing

The personal data you provide to Luneur may be used:

(a) to fulfil obligations deriving from the Season Ticket contract established with the same Luneur;

(b) to respond to and comply with all your requests and for any technical/organisational communications, both verbal and in writing;

(c) to conduct statistical surveys and market research studies;

(d) to send informative and promotional notices, advertising material and offers for goods and services by mail, over the internet, over the telephone, by email, by MMS and by text message from Italy or from abroad (also from countries outside the European Community) from Luneur or from natural or legal persons that cooperate with Luneur itself;

(e) to send the Luneur newsletter.

1. Processing methods

The processing is carried out by means of the operations or set of operations indicated in Article 4(1)(2) of Regulation (EU) 2016/679; i.e. collection, recording, organisation, storage, consultation, structuring, processing, adaptation, modification, selection, extraction, comparison, use, dissemination, interconnection, blocking, destruction.

These operations may be carried out with or without the assistance of electronic or other computer-based instruments.

The processing is carried out by the Data Controller and/or by the Data Processors appointed by the Data Controller.

1. Provision of data and consequences of refusal

The provision of your personal data in relation to the purposes set out in points (a) and (b) is mandatory (without it, we will not be able to provide you with the Season Ticket services). Data provision is optional in relation to the purposes referred to in points (c), (d) and (e).

1. Disclosure of your personal data

Within Luneur, your personal data may be disclosed to shareholders, members of the administrative body, members of the board of statutory auditors, auditors, company personnel and, in any case, to the Data Processor and data processors appointed by Luneur in the performance of their duties.

Personal data may also be disclosed to other recipients appointed as Data Processors, pursuant to Article 28 of the GDPR, for the performance of specific processing tasks relating to the correct and complete execution of the contract.

1. Dissemination of your personal data

Your personal data will not be disseminated.

1. Data retention

The personal data you provide to Luneur will be kept for a period not exceeding that necessary to pursue the aforementioned purposes.

1. Transfer of data abroad

Personal data may be transferred to countries within and outside the European Union, or to an International Organisation, exclusively within the scope of the purposes of the contract and provided that such parties have provided adequate guarantees in accordance with Article 46 of the GDPR.

1. Rights of data subjects

Art. 15 of the Regulation enables data subjects to exercise specific rights, including the right to obtain confirmation from the data controller as to whether or not personal data concerning them exist and have such data made available in an intelligible form. Data subjects also have the right to be informed of the source of the data, the purposes and methods of related processing, the rationale for the processing, the identification details of the data controller and of the persons to whom the data may be disclosed. Data subjects also have the right to obtain the updating, rectification and integration of the data, the erasure, restriction of processing, the transformation into anonymous form or the blocking of data processed in breach of the law and its portability. Data subjects may also oppose the processing of data for legitimate reasons.

Data subjects may revoke their consent at any time, limited to cases where the processing is based on their consent for one or more specific purposes and concerns common personal data or particular categories of data. Processing based on consent and performed prior to the withdrawal of consent shall, however, remain lawful.

Without prejudice to any other administrative and jurisdictional remedies, if you believe that the processing of data relating to you is in breach of the GDPR, pursuant to Article 15(1)(f) of the GDPR you have the right to file a complaint with the Supervisory Authority (i.e. the Italian Data Protection Authority).
